2. Scope
This Return Policy describes your rights and our procedures regarding:
- Right of withdrawal: Your right as a consumer in the European Union (including the Netherlands) to cancel a distance contract within a specified period without giving a reason (subject to certain exceptions).
- Returns and refunds: How to return products, request a refund, or report defective goods.
This policy should be read together with our Terms of Service. In the event of conflict, the mandatory provisions of applicable consumer law prevail.
3. Right of withdrawal (consumer distance contracts)
If you are a consumer and you have purchased products from us at a distance (e.g. via our website), you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party you designate) take physical possession of the goods.
3.1 How to exercise the right of withdrawal
To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. by letter, email, or telephone). You may use the following model wording, but it is not obligatory: "I hereby give notice that I withdraw from my contract of sale of [product name]." You can send this to our email or postal address set out in section 1. To meet the withdrawal deadline, it is sufficient that you send your communication before the 14-day period has expired.
3.2 Effects of withdrawal
If you withdraw from the contract, we shall reimburse all payments received from you, including delivery costs (except for any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery we offer), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. We are not responsible for any loss or damage to goods in transit when returned by you.
3.3 Exceptions to the right of withdrawal
Your right of withdrawal does not apply in the following cases (among others, as set out in Directive 2011/83/EU and national implementation):
- Supply of goods that are sealed and not suitable for return due to health protection or hygiene reasons, if they have been unsealed after delivery (e.g. sealed food supplements that you have opened).
- Supply of goods that are liable to deteriorate or expire rapidly.
- Supply of goods made to the consumer's specifications or clearly personalised.
For sealed food supplements (including Activeronix), once the seal is broken or the product has been used, the right of withdrawal may be lost in accordance with the above. If the product is returned unopened and in its original condition, we will process the withdrawal and refund in accordance with this policy. If you are unsure whether your product is eligible for withdrawal, please contact us before returning it.
4. Defective products and legal warranty
Under Dutch and EU consumer law, you are entitled to remedies if the product we supply does not conform to the contract (e.g. it is defective, not as described, or not fit for purpose). Your rights may include repair, replacement, price reduction, or termination of the contract (with refund). The exact remedies and time limits depend on the nature of the non-conformity and applicable national law (e.g. Dutch Civil Code (Burgerlijk Wetboek)).
If you believe the product you received is defective or does not conform to the contract, please contact us as soon as possible with your order details and a description of the issue. We will investigate and, where appropriate, offer a remedy (e.g. replacement or refund) in accordance with the law.
5. Return procedure (step-by-step)
- Contact us: Notify us of your wish to return the product (e.g. to exercise the right of withdrawal or to report a defect) by email or phone using the details in section 1. We may ask you for your order number and the reason for the return.
- Pack the product: Pack the product securely, preferably in its original packaging if possible. For withdrawal, the product should be in unused condition (unopened or as received). For defective products, follow any instructions we give you.
- Send the product: Send the product to the address we provide. For withdrawal, you bear the cost of return. We recommend using a trackable delivery service. We are not liable for loss or damage during return shipment until we receive the product.
- Refund: Once we have received and checked the product, we will process your refund (or replacement, where applicable) as described in this policy and in accordance with the law. Refunds are normally processed within 14 days of our receipt of the returned product or of your evidence of return.
6. Refund method and timing
Refunds will be made using the same payment method you used for the original purchase, unless we agree otherwise with you. Refunds are processed without undue delay and in any event within the time limits set by applicable law (e.g. 14 days for withdrawal). If you have not received your refund within the expected time, please contact us and we will look into it.
7. Partial returns and multiple items
If you ordered multiple items and wish to return only some of them, or if you have a partial refund request, please contact us. We will handle such requests in accordance with this policy and applicable law.
8. Changes to this Return Policy
We may update this Return Policy from time to time to reflect changes in our practices or in the law. The "Last updated" date at the top will be revised when changes are made. For orders already placed, the version of the Return Policy in effect at the time of the order will generally apply. We encourage you to review this page periodically.
